SkyDynamics is an independent company, not EASA, ICAO, the FAA or any aviation authority. Regulatory terms such as EBT, CBTA, FSTD and FNPT II are used descriptively. Customer, partner and aircraft manufacturer names and logos belong to their owners and do not imply endorsement.

SkyDynamics is an independent, privately owned aviation technology company. It is not EASA, ICAO, the FAA or any other aviation authority, it is not affiliated with or acting for any of them, and no reference on this website to an authority, a regulation, a customer, a partner or a manufacturer means that they approve, endorse or sponsor SkyDynamics. Third-party names and logos belong to their owners; we use them only to identify real relationships, the aircraft types we represent or the systems we work with, and we claim no rights in them.

This Legal Disclaimer forms part of the SkyDynamics Terms of Use and applies to the website at https://skydynamics.aero and all material published through it (the "Website"). Capitalised terms not defined here have the meaning given in the Terms of Use.

Key points:

  • Not a regulator. SkyDynamics does not qualify FSTDs, approve training programmes or issue any certificate, licence, rating or approval.
  • Regulatory terms are descriptive. Names such as EASA and terms such as EBT, CBTA, FSTD or FNPT II describe the regulatory framework our products serve. They are not a claim of approval.
  • Customer logos identify real relationships. They do not mean the organisation endorses SkyDynamics, and all rights in them remain with their owners.
  • Manufacturer names identify aircraft types. Our simulators and data are not made or approved by the aircraft manufacturer unless we say so expressly.
  • Compliance stays with the operator. The approved organisation and its accountable manager remain responsible for regulatory compliance.

1. Independence and non-affiliation

1.1. SkyDynamics is an independent commercial undertaking. It is not a public body, an institution, body, office or agency of the European Union, an intergovernmental organisation, or a national civil aviation authority, and it does not exercise any public authority or regulatory function.

1.2. Unless a written agreement that SkyDynamics has made public states otherwise, SkyDynamics is not affiliated with, authorised by, endorsed by, sponsored by or otherwise officially connected with any authority, organisation, company, manufacturer or research institution named on the Website. No partnership, joint venture, agency, franchise or employment relationship is created or implied by any such reference.

2. Aviation authorities and regulatory terminology

2.1. SkyDynamics is not an aviation authority. SkyDynamics is not, and is not connected with or acting on behalf of, the European Union Aviation Safety Agency (EASA), the European Commission, the International Civil Aviation Organization (ICAO), the US Federal Aviation Administration (FAA), the Hellenic Civil Aviation Authority (HCAA), the Swiss Federal Office of Civil Aviation (FOCA) or any other national or international aviation authority (each an "Authority"). Nothing on the Website is an official statement, decision, interpretation or guidance of any Authority.

2.2. Descriptive use of names and terms. The Website uses the names and acronyms of Authorities, and terms defined in or derived from aviation regulation, only to describe the regulatory environment in which SkyDynamics products are designed to be used. These include, for example, EASA, ICAO, FAA, EBT (evidence-based training), CBTA (competency-based training and assessment), FSTD (flight simulation training device), FFS, FTD, FNPT I, FNPT II (also written FNPT 2), BITD, MCC, MPL, ATO, ATQP, SEP IR, MEP IR, UPRT, CS-FSTD(A), QTG, AMC, GM, Part-FCL, Part-ORA, Part-ORO, Part-66, Part-145, Part-147, Part-CAMO and Part-IS. These are the common terms of the aviation industry. Their use does not indicate any approval, endorsement or relationship, and SkyDynamics claims no ownership of, or exclusive right in, any of them.

2.3. Names, logos and emblems of Authorities. The names, acronyms, logos and emblems of Authorities belong to those Authorities or to the European Union, and the emblems of intergovernmental organisations are protected under Article 6ter of the Paris Convention for the Protection of Industrial Property. SkyDynamics does not use them to suggest approval, endorsement or official status. If an Authority's name or logo appears on the Website, for example on a reproduced qualification certificate, in an event report or in a citation, it appears solely to identify that Authority accurately and factually.

2.4. Regulatory texts. References to legislation and regulatory material, including Regulation (EU) 2018/1139, Commission Regulation (EU) No 1178/2011, Commission Regulation (EU) No 965/2012, their implementing and amending acts, EASA certification specifications, acceptable means of compliance and guidance material, and ICAO documents such as Doc 9995 and Doc 9868, are made for information. Summaries on the Website are simplified and may not reflect the latest amendments. Only the texts published in the Official Journal of the European Union are authentic for EU law; EASA and ICAO publications should be consulted in their current official versions. Copyright in regulatory publications remains with their publishers.

2.5. How to read qualification and compliance statements. Under EU law, an FSTD is qualified by the competent authority (a national aviation authority or, where EU law provides, EASA), for a specific device, operated by a specific FSTD operator, at a specific qualification level and within the scope stated on its qualification certificate. Accordingly:

  • Where the Website says that a SkyDynamics device "has been qualified", that statement refers only to that specific device and configuration, under the certificate issued by the competent authority to its operator, and remains subject to recurrent evaluation. It does not extend to other devices, locations, configurations or software versions.
  • Words such as "designed to CS-FSTD(A)", "built for FNPT II qualification", "EASA-compliant", "aligned with ICAO Doc 9995" or "supports EBT and CBTA" describe the design intent and capability of a product. They are not a statement that an Authority has approved the product or will approve its use in a particular programme.
  • Training credits, EBT or ATQP programme approvals, operator approvals and qualification outcomes depend on the competent authority and on the operator's own programme, procedures and data. SkyDynamics does not guarantee any regulatory outcome.

2.6. Responsibility remains with the approved organisation. SkyDynamics products and services assist organisations with their training, qualification, maintenance, safety and compliance work. They do not transfer, replace or reduce the obligations of the approved organisation, its accountable manager, compliance monitoring function, instructors, examiners and personnel under the applicable aviation regulations. Organisations should confirm regulatory requirements with their competent authority.

3. Customers, partners and research institutions

3.1. What the logos mean. The names and logos of organisations shown on the Website (for example in "Organisations that work with SkyDynamics", case studies, news, delivery reports and testimonials) identify organisations that are, or have been, customers, users, suppliers, research partners or project partners of SkyDynamics. They are shown to describe that factual relationship accurately and, where an agreement so requires, with the organisation's permission.

3.2. What the logos do not mean. The display of an organisation's name or logo does not mean that the organisation endorses, recommends or sponsors SkyDynamics or any of its products, that it uses every SkyDynamics product, or that it has reviewed or adopted any statement on the Website. A relationship may be limited to a particular product, project, location or period, and may have ended. The Website is not a statement of any organisation's current supplier arrangements.

3.3. Ownership. All names, logos, trade marks and other signs of customers, partners and research institutions are the property of their respective owners. SkyDynamics claims no right, title or interest in them and uses them in accordance with honest practices in industrial and commercial matters. No licence to use them is granted to any visitor, and they may not be copied or extracted from the Website.

3.4. Case studies and testimonials. Case studies describe the circumstances of a particular organisation and project; results depend on many factors and will differ between organisations. Testimonials reflect the personal views of the individuals quoted and not necessarily those of their employers. Some testimonials and case studies are anonymised for confidentiality.

3.5. Location references. References to the Foundation for Research and Technology - Hellas (FORTH) and its technology park identify where SkyDynamics is located and, where stated, research collaboration. They do not imply that FORTH is responsible for SkyDynamics products or statements.

3.6. Removal on request. If you represent an organisation and would like its name or logo removed or its description changed, please write to info@skydynamics.aero. We will act on legitimate requests within ten (10) business days.

4. Aircraft manufacturers and aircraft types

4.1. Aircraft manufacturer names, logos and aircraft type designations (including Airbus, A320, A220, Boeing, B737, ATR, ATR 72, De Havilland, Dash 8, Q400, Textron Aviation, Cessna, C172, Beechcraft, King Air 350, Piper, Seneca, Diamond Aircraft, DA40, DA42, DA62, Embraer, Aérospatiale, BAE Systems, Fokker and Dassault Aviation) are the property of their respective owners.

4.2. They are used on the Website only to identify the aircraft type or class that a simulator, flight model, scenario dataset or software function represents or supports, and the logos shown under fleet coverage indicate the aircraft families covered by our data. Unless expressly stated, SkyDynamics simulators, flight models and data are not manufactured, supplied, licensed, approved or endorsed by the aircraft manufacturer, and the aircraft manufacturer has no responsibility for them.

4.3. Flight models, systems simulations and training data are prepared for training purposes. They are not a source of aircraft operating data and must not be used in place of the approved flight manual, operating manuals, maintenance data or other approved documentation for the aircraft.

5. Other trade marks and technology providers

5.1. Other names and marks referenced on the Website, including simulation, training, software, cloud, data and industry names such as CAE, FlightSafety International, L3Harris, TRU Simulation + Training, X-Plane (Laminar Research), Prepar3D (Lockheed Martin), FlightGear, Microsoft Flight Simulator, Microsoft, Microsoft 365, Azure, Windows, Google Workspace, Apple, iPad, iOS, macOS, PencilKit, Dropbox, Navigraph, AMOS (Swiss-AS), IATA and IOSA, are the property of their respective owners.

5.2. They are used only to identify products or services with which SkyDynamics products are compatible, which they integrate with or run on, or with which they are compared. Comparisons reflect SkyDynamics' own assessment at the time of publication, based on publicly available information.

6. Legal basis for referring to third-party marks

SkyDynamics refers to third-party names and marks only as far as necessary to identify their owners, products or services, without using their stylised logos except as described in Sections 2.3, 3 and 4, and without suggesting sponsorship or endorsement. This referential use is permitted in the European Union by Article 14 of Regulation (EU) 2017/1001 on the European Union trade mark and by the national provisions implementing Article 14 of Directive (EU) 2015/2436, which in Greece is Law 4679/2020; in the United States by the doctrine of nominative fair use recognised under the Lanham Act; and in Switzerland by the corresponding principles of Swiss trade mark and unfair competition law.

7. Compatibility and interoperability

7.1. Statements that a SkyDynamics product is "compatible with", "integrates with", "supports" or "runs on" a third-party product, standard or platform describe its technical capability, based on SkyDynamics' evaluation of the third-party version and documentation available at the time.

7.2. Third parties may change, restrict or withdraw their products, interfaces and terms at any time. SkyDynamics does not guarantee continued compatibility and is not responsible for any loss of functionality caused by such changes. Customers are responsible for keeping their own systems within the supported configurations stated in their Customer Agreement.

8. Product information, images and roadmap

8.1. Product descriptions, specifications, aircraft type lists and availability are general information, may vary by configuration, region and contract, and may change without notice. They form part of a contract only if a Customer Agreement expressly incorporates them.

8.2. Images on the Website may be illustrations, renderings, composites or photographs of specific installations. They may show optional equipment, configurations or features that are not included in every product.

8.3. Features described as planned, in development, on the roadmap or "coming soon" are statements of current intention. They are not a commitment to deliver any feature by any date.

9. Not operational, safety or training advice

9.1. Nothing on the Website is operational information. It must not be used for flight planning, navigation, operating an aircraft, determining airworthiness or releasing an aircraft to service.

9.2. Training content, scenarios, research findings and articles on the Website are general information. They do not replace an approved training programme, the judgement of instructors and examiners, or the procedures of the organisation concerned.

9.3. Nothing on the Website is legal, regulatory, financial, engineering or other professional advice. You should obtain independent professional advice before acting on it.

10. AI-enabled products

Descriptions of AeroBrain and other AI-enabled functions describe decision-support capabilities. AI outputs can be incomplete or wrong. In SkyDynamics products they are designed to be reviewed and confirmed by a qualified person, who remains responsible for any decision taken. Examples on the Website are illustrative and do not guarantee the output in a particular case.

11. Investor information and forward-looking statements

11.1. Information on the Website, including on the Investor Relations pages, is provided for general information only. It is not an offer to sell, or a solicitation of an offer to buy, any securities or other interests in SkyDynamics in any jurisdiction. It is not a prospectus within the meaning of Regulation (EU) 2017/1129, and no securities have been registered under the US Securities Act of 1933. It is not investment advice.

11.2. The Website may contain forward-looking statements about plans, products, markets and regulatory developments, identified by words such as "plan", "expect", "intend", "aim", "will" and "may". They reflect current expectations and involve risks and uncertainties, and actual results may differ materially. SkyDynamics undertakes no obligation to update them, except as required by law.

12. External links

Links to third-party websites are provided for convenience. SkyDynamics does not control those websites and is not responsible for their content, availability or privacy practices. A link does not imply endorsement in either direction.

13. Accuracy and liability

SkyDynamics takes reasonable care to keep the Website accurate and current but makes no representation or warranty that it is complete, accurate or up to date. The disclaimer of warranties, limitation of liability, governing law and dispute resolution provisions of the Terms of Use apply to this Legal Disclaimer and to all Website content.

14. Intellectual property notices

14.1. If you own a trade mark, logo, copyright or other right and believe that the Website uses it improperly, please write to info@skydynamics.aero with: (a) the right concerned and evidence of your ownership or authority to act; (b) the specific page and material; (c) why you consider the use improper; (d) your contact details; and (e) a statement that the information in your notice is accurate.

14.2. We will acknowledge legitimate notices promptly and, where appropriate, remove or amend the material. Sending a notice does not waive any right or defence of either party.

15. Changes

SkyDynamics may update this Legal Disclaimer at any time. The version published on the Website, with the date shown at the top, applies.
