Terms of Use
The terms that govern use of the SkyDynamics website. SkyDynamics products, FSTDs and services are supplied only under a separate customer agreement. Covers intellectual property, third-party names and logos, aviation regulatory responsibility, liability and governing law (Greece, United States).
Terms of Use

These Terms of Use ("Terms") govern your access to and use of the SkyDynamics website at https://skydynamics.aero, its sub-domains and the information, documents, downloads, forms, demonstrations and communications made available through it (together, the "Website"). By using the Website you accept these Terms, our Legal Disclaimer and our Privacy Policy, which form part of these Terms. If you do not accept them, do not use the Website.
In short (for convenience only, not a substitute for the full Terms):
- The Website is for professional information. SkyDynamics products, flight simulation training devices (FSTDs) and services are supplied only under a separate signed agreement, which always takes priority over these Terms.
- SkyDynamics is an independent company. It is not EASA, ICAO, the FAA or any other aviation authority, and it does not act for any of them. Regulatory names and terms are used only to describe the framework our products serve.
- Names and logos of customers, partners, aircraft manufacturers and other third parties belong to their owners. We show them to identify real relationships or compatibility, and we claim no rights in them.
- Regulatory compliance, training programme approval and the operation of aircraft and devices remain the responsibility of the approved organisation and its accountable manager.
- The Website is provided "as is"; our liability for it is limited as far as the law allows.
1. Who we are
1.1. In these Terms, "SkyDynamics", "we", "us" and "our" mean the SkyDynamics company established in Heraklion, Crete, Greece, which operates the Website, together with its affiliated company incorporated in the State of Delaware, United States, and its Swiss branch, each of which may rely on these Terms. "You" means the individual using the Website and, where you use it for an organisation, that organisation.
1.2. Our principal office is at N. Plastira 100, Step-C Technology Park, Foundation for Research & Technology Hellas, 70013 Heraklion, Crete, Greece. You can reach us at info@skydynamics.aero.
2. Other agreements take priority
2.1. These Terms cover the Website only. Access to our software platforms (including AeroEBT, AeroBrain, AeroTechLog, AeroMasterEFB, OpsEye, Wingman, FleetSnap and FCS++), the supply of flight simulators and FSTDs, hosting, maintenance, qualification support, consulting and any other product or service is provided solely under a separate written agreement between SkyDynamics and the customer organisation, together with its order forms, licence terms, service levels and data processing agreement (a "Customer Agreement").
2.2. If these Terms conflict with a Customer Agreement, the Customer Agreement prevails. Nothing in these Terms grants any right to use a SkyDynamics product or service that is not granted by a Customer Agreement.
3. Professional use and eligibility
3.1. The Website is directed at aviation, training, maintenance, defence and technology professionals and the organisations they represent. It is not directed at consumers or at children.
3.2. You confirm that you are at least 18 years old and, where you act for an organisation, that you are authorised to accept these Terms on its behalf.
4. Website information is not an offer
4.1. Product descriptions, specifications, aircraft type lists, prices, timelines and other information on the Website are general information and an invitation to contact us. They are not an offer capable of acceptance and do not form part of any contract unless expressly incorporated into a signed Customer Agreement or a written quotation that states it is binding.
4.2. Proposals and quotations are valid only for the period and on the conditions they state.
5. Our intellectual property
5.1. The Website and its content, including text, software, page design, illustrations, photographs, videos, diagrams, data, documents and the selection and arrangement of that content, are owned by SkyDynamics or its licensors and are protected by copyright, database, trade mark, trade secret and other intellectual property laws of Greece, the European Union, the United States, Switzerland and other countries, and by international treaties.
5.2. SkyDynamics, the SkyDynamics logo and the names AeroEBT, AeroBrain, AeroTechLog, AeroMasterEFB, OpsEye, Wingman, FleetSnap, FCS++ (FCS Plus), EBT Scenario Builder and Contextual Composition Protocol, and related logos, are trade marks, trade names or service marks of SkyDynamics, whether or not registered. You may not use them without our prior written consent, except to refer accurately to SkyDynamics and its products in a way that does not suggest endorsement.
5.3. Regulatory and industry terms such as EBT, CBTA, FSTD, FNPT II, CS-FSTD(A), QTG, ATQP or Part-IS are generic terms of the aviation regulatory framework. SkyDynamics claims no exclusive rights in them, including where they form part of a product description.
5.4. All rights not expressly granted in these Terms are reserved.
6. How you may use the Website
6.1. We grant you a limited, revocable, non-exclusive, non-transferable licence to view the Website and to download or print a reasonable number of pages and documents for your own internal evaluation of SkyDynamics and its products, provided you keep all copyright and proprietary notices intact.
6.2. You must not, without our prior written consent: (a) copy, republish, sell, license or commercially exploit Website content; (b) modify it or create derivative works from it; (c) frame or mirror the Website; (d) remove or alter any notice of ownership; or (e) extract a substantial part of any database on the Website.
6.3. Search engines and AI answer services may index, summarise and cite the Website in accordance with our published robots.txt file and llms.txt file. Any other automated access, scraping or bulk extraction requires our prior written consent.
7. Third-party names, logos and regulatory references
7.1. The Website refers to aviation authorities, international organisations, aircraft manufacturers, customers, partners, research institutions and technology providers, and may display their names and logos. Those references are governed by our Legal Disclaimer, which forms part of these Terms.
7.2. In summary: (a) SkyDynamics is not affiliated with, authorised by or acting for any aviation authority or other body it mentions; (b) customer and partner names and logos identify organisations that are or have been customers, users, partners or project partners of SkyDynamics, and are the property of their owners; (c) aircraft and product names identify the type represented or the system we are compatible with; and (d) no reference implies endorsement, sponsorship or approval, and SkyDynamics claims no right, title or interest in any third-party name, logo or mark.
7.3. You may not copy, extract or reuse any third-party name, logo or mark from the Website. Any right to use it must be obtained from its owner.
8. Acceptable use
You must not:
8.1. use the Website in breach of any law or regulation, or of any third party's rights;
8.2. introduce malware or harmful code, or attempt to gain unauthorised access to the Website, its servers or any connected system or data;
8.3. probe, scan or test the vulnerability of the Website or breach any security or authentication measure, unless we have authorised it in writing (if you believe you have found a vulnerability, please report it to info@skydynamics.aero and do not exploit or disclose it);
8.4. interfere with, overload or disrupt the Website, including by denial-of-service attacks;
8.5. impersonate any person or organisation, or misrepresent your affiliation with SkyDynamics or anyone else;
8.6. submit false, misleading, defamatory or unlawful material, or personal data of others that you have no right to share; or
8.7. use the Website or its content to develop or benchmark a competing product or service, or to train machine-learning models for that purpose.
9. Information you send us
9.1. When you contact us, book a demonstration, register for an event or subscribe to updates, you confirm that the information you provide is accurate and that you are entitled to provide it. Personal data is handled under our Privacy Policy.
9.2. Please do not send confidential or proprietary information through the Website unless a confidentiality agreement is in place. Unless such an agreement applies, information you send is not treated as confidential.
9.3. If you give us suggestions or feedback about our products or the Website, you grant SkyDynamics a perpetual, worldwide, royalty-free right to use it for any purpose, without obligation to you.
10. Downloads, demonstrations, events and trials
10.1. Brochures, white papers, research papers, webinars and recordings are provided for information. Their use is subject to these Terms and to any additional terms shown with them.
10.2. Demonstrations, evaluation copies, pilot projects and trial access are provided only under the terms communicated for them or in a Customer Agreement. They may not be used for operational, regulatory or training-credit purposes unless those terms expressly allow it.
11. Third-party services and links
11.1. The Website may link to or embed third-party websites and services (for example maps, video platforms, social networks, scheduling and analytics tools). SkyDynamics does not control them and is not responsible for their content, availability, security or privacy practices. Your use of them is governed by their own terms.
11.2. A link does not mean that SkyDynamics endorses the linked website or its operator, or that the operator endorses SkyDynamics.
12. Aviation and regulatory responsibility
12.1. Information on the Website about regulations, acceptable means of compliance, guidance material, training programmes, FSTD qualification, airworthiness, maintenance or safety management is general information. It is not legal, regulatory, engineering or operational advice and is not an official interpretation by any authority.
12.2. SkyDynamics does not approve training programmes, qualify FSTDs, issue licences, ratings, certificates or approvals, or make airworthiness determinations. Those decisions belong to the competent authority. Compliance with the applicable aviation regulations, including the design and approval of an EBT or CBTA programme and the operation of any aircraft or device, remains the sole responsibility of the approved organisation and its accountable manager.
12.3. Nothing on the Website may be used for flight planning, navigation, the operation of an aircraft or the release of an aircraft to service. Always use the approved and current documentation for the aircraft, device and operation concerned.
13. Disclaimer of warranties
13.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY, REPRESENTATION OR CONDITION OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TITLE OR NON-INFRINGEMENT.
13.2. In particular, SkyDynamics does not warrant that the Website will be uninterrupted, secure or free from errors or harmful components, that content is complete, accurate or current, or that any defect will be corrected. Warranties for SkyDynamics products and services are given only in a Customer Agreement.
14. Limitation of liability
14.1. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SKYDYNAMICS, ITS AFFILIATES AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS SHALL NOT BE LIABLE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF STATUTORY DUTY OR OTHERWISE, FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFIT, REVENUE, BUSINESS, CONTRACT, GOODWILL, DATA OR ANTICIPATED SAVINGS, OR FOR ANY LOSS ARISING FROM AIRCRAFT OR DEVICE UNAVAILABILITY, FLIGHT DISRUPTION OR REGULATORY ACTION, ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE OR ANY RELIANCE ON ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS.
14.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SKYDYNAMICS AND ITS AFFILIATES ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE AND THESE TERMS SHALL NOT EXCEED ONE HUNDRED EUROS (EUR 100) OR, FOR USERS IN THE UNITED STATES, ONE HUNDRED US DOLLARS (USD 100).
14.3. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, under mandatory product liability law, or for wilful misconduct or gross negligence (including as provided in Article 332 of the Greek Civil Code and Article 100 of the Swiss Code of Obligations). Some jurisdictions, including some US states, do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the fullest extent permitted by law.
14.4. The limitations in this Section 14 apply to the Website. Liability relating to SkyDynamics products and services is governed exclusively by the relevant Customer Agreement.
15. Indemnity
If you use the Website for an organisation, you and that organisation will indemnify and hold harmless SkyDynamics and its affiliates, directors, officers, employees and agents against any third-party claim, and the resulting losses, damages, costs and reasonable legal fees, arising from your breach of these Terms, your misuse of the Website or its content, or your infringement of any right of a third party. This Section does not apply to consumers.
16. Export controls and sanctions
16.1. Information, software and technology made available by SkyDynamics may be subject to export control and sanctions laws, including Regulation (EU) 2021/821 (dual-use items), EU restrictive measures adopted by the Council of the European Union, Greek and Swiss export control and embargo legislation, and US law including the Export Administration Regulations, the International Traffic in Arms Regulations and sanctions administered by the Office of Foreign Assets Control.
16.2. You confirm that you are not located in, or ordinarily resident in, a country or territory subject to comprehensive sanctions, and that you are not a person, or owned or controlled by a person, listed on any sanctions list of the European Union, the United Nations, Switzerland, the United Kingdom or the United States. You must not access, download or use Website content in breach of those laws. We may refuse any request or communication where we believe this is necessary for compliance.
17. Suspension
We may suspend, restrict or withdraw access to all or part of the Website at any time, without notice and without liability, including for maintenance, security or legal reasons, or where we reasonably believe you have breached these Terms.
18. Governing law and disputes
18.1. General. These Terms, and any dispute or claim arising out of or in connection with them or the Website (including non-contractual disputes or claims), are governed by the laws of the Hellenic Republic, excluding its conflict-of-law rules. The courts of Heraklion, Crete, Greece have exclusive jurisdiction, subject to Sections 18.2 and 18.3.
18.2. Users in the United States. If you are located in the United States, these Terms are an agreement with SkyDynamics' affiliated company incorporated in Delaware, and they are governed by the laws of the State of Delaware and applicable US federal law, excluding conflict-of-law rules. Any dispute will be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, in English, seated in Wilmington, Delaware. The Federal Arbitration Act governs this agreement to arbitrate. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual property or confidential information. YOU AND SKYDYNAMICS EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. You may opt out of this arbitration agreement by emailing info@skydynamics.aero within 30 days of first accepting these Terms, stating your name, organisation and your decision to opt out; in that case the state and federal courts located in Delaware have exclusive jurisdiction.
18.3. Mandatory rights. If you are a consumer, nothing in these Terms deprives you of the protection of mandatory provisions of the law of your country of habitual residence or of any right to bring proceedings in the courts of that country where that law so provides.
18.4. Amicable resolution first. Before starting any proceedings, the party raising a dispute will notify the other in writing and both will try in good faith to resolve it within 30 days.
18.5. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
19. Changes to these Terms
We may update these Terms from time to time. The updated Terms apply from the date shown at the top of this page. We will highlight material changes on the Website. Your continued use of the Website after that date means you accept the updated Terms.
20. General
20.1. Entire agreement. These Terms, the Legal Disclaimer and the Privacy Policy are the entire agreement between you and SkyDynamics about the Website. They do not replace any Customer Agreement.
20.2. Severability. If a court or arbitrator finds any provision invalid or unenforceable, it will be enforced to the maximum extent permitted and the rest of these Terms will remain in effect.
20.3. No waiver. A failure or delay in enforcing any provision is not a waiver of it.
20.4. Assignment. You may not assign or transfer your rights or obligations under these Terms. SkyDynamics may assign or transfer them to an affiliate or to a successor of its business.
20.5. Force majeure. SkyDynamics is not liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, cyber-attacks, failures of utilities, telecommunications or hosting providers, governmental acts, sanctions and labour disputes.
20.6. No third-party beneficiaries. Except for the affiliates and persons referred to in Sections 1, 14 and 15, no third party has any right to enforce these Terms.
20.7. Language. These Terms are written in English. If we provide a translation, the English version prevails to the extent permitted by law.
20.8. Survival. Sections 5, 7, 9.3, 12 to 16, 18 and 20 survive any termination of your right to use the Website.
